IJTIHAADI MASAA'IL KE BAARE ME RASOOL PAAK (sallallahu alaihi wa sallam) KA FAISLAH:

Bismillaahir Rahmaanir Raheem

IJTIHAADI MASAA'IL KE BAARE ME RASOOL PAAK
(sallallahu alaihi wa sallam) KA FAISLAH:

Hazrat Umroo bin Al-Aas aur Hazrat Abu
Hurairah (raziallahu anhum) farmate hain ke:
"Jab Haakim Ijtihaad se faislah karey aur Saheeh
faislah par Pohanch Jaaye to Usko 2 Ajar milte
hain aur Agar Haakim Ijtihaad se Faislah Karey
aur Khata' ho Jaaye to 1 Ajar ka MUSTAHIQ
hai." [Bukhari Shareef 2/92]


Is Hadees se ma'loom hua ke MUJTAHID
Ma'soom to Nahi hota Kyonke Ijtihaad me Khata'
ka Ahtemaal bhi hai, Magar Wo Mat'oon bhi
Nahi hota ke Us par Zubaan Ta'n Daraaz ki Jaaye
balke MUJTAHID ke liye har Haal me AJAR
maujood hai.
Jis ko Allah ta'la Ajar de raha hai, Us par Ta'n
Karne wala Apna hi NUQSAAN karta hai.
Imam Nawawi (rahimahullah) farmate hain ke:
"Musalmano ka ittifaaq hai ke Mujtahid har
Ijtihad me Ajar pata hai. Agar uska ijtihad durust
nikla toh 2 Ajar ka Mustahiq hai, 1 ajar ijtihad
ka dusra Isbat (Sahih baat pane) ka aur ijtihad
Khata' nikla toh bhi 1 Ajar ijtihad ka milega.
Haan, jo Na Ahal hai usko ijtihad se Hukm karna
kisi haal me Jayez nahi balke Wo Gunahgaar hai.
Uska Hukm Naafiz bhi nahi hoga agarche uska
Hukm Haqq ke muwafaq ho ya Mukhalif, kyonke
Uska Haqq ko paa lena mehaz ittefaqi hai. Kisi
asal Shara'i par Mubni nahi. Pas wo tamam
Ahkam me Gunahgar hai Haqq ke muwafaq ho ya
mukhalif aur uske nikaaley hue tamam Ahkaam
Mardood (rejected) hain. Uska koi uzr Shari'an
Maqbool Nahi." [Sharah Nawawi Muslim 2/76]
Mujtahid ke Ijtihaadi Faislah ko Tasleem karne
wala MUQALLID hota hai. Aur Jo Shaqs Na Khud
HAAKIM MUJTAHID ho aur Na Haakim ke Faisley
ko Tasleem Karta hai, Wo Baaghi kehlaata hai.
(Naam Nihaad) Ahl-e-Hadees Firqay se Ta'lluq
rakhne waaley tamam BAAGHI hain. Aur Is
BAGHAAWAT ki Ijaazat me Unke Paas QUR'AN
WA HADEES se Koi Daleel maujood Nahi. Aur Inki
TEHQEEQ Asal Shari'at per mubni Nahi hai balke
ye JAAHILON ki MUNAZI'AT hai.
Agar LA-MAZHAB (Naam Nihaad) Ahl-e-Hadees
waaqe' me Rasoolullah (sallallahu alaihi wa
sallam) ko maante to Aitraaz Kartey waqt Ye
kehte ke Meri Naaqis Raa'i me Ye Chand Masaa'il
hain Jinme Imam Abu Haneefah (rah.) se Ghalti
hui hai, aur Meri Ghair-Ma'soom aur Naaqis
Raa'i me Imam Sahab (rah.) ko in Masaa'il me
sirf 1 Ajar mila hai aur Ye Haaq bhi Aap logon
ko Us waqt hota Jab Aap Khud IJTIHAAD ke Ahal
hotey, warna Aap logon ko Ye kehne ka bhi Haqq
hargiz Na tha.
RASOOLULLAH (sallallahu alaihi wa sallam) KA EK
AUR FAISLAH:
Hazrat Ubaadah bin Saamit (raz.) farmaate hain
ke:
"Humne Rasoolullah (sallallahu alaihi wa sallam)
ke Dast Mubarak (Hathon) par Kayi Amoor ke
baare me Bi'at ki Jinme Ek Ye baat bhi thi ke
Hum Kisi Amr ke Ahal se Jhagraa Nahi
Karengey." [Nasa'i 2/159]
Ya'ni Justice se Iqtilaaf ka Haqq Justice ko hota
hai Kisi Na-Ahal MULZIM ko Nahi hota. Isi tarah
Doctor se Iqtilaf ka Haqq Doctor ko hota hai,
Mareez ko Nahi. Hargiz Nahi.
Isi tarah Mujtahid se Iqtilaf ka Haqq doosrey
Mujtahid ko to ho sakta hai lekin Baaghi Ghair-
Muqallideen ko Hargiz Nahi hai.
Lekin Ye log Muttaba-e-Shaitaan Jo Tehrey isliye
Rasoolullah (sallallahu alaihi wa sallam) ke is
Usool ko bhi Nahi maantey. Aur Har Jaahil Apni
Naaqis Aql ki bunyaad par Mujtahideen par
Ilzamaat Lagaata hai, Qur'an wa Ahaadees ki
Mukhalifat ka Ilzaam lagaane se bhi Peeche Nahi
hota.
CHALLENGE:
Aam Taur par La-Mazhab, Ye Kehte hain ke Hum
4 Imamon ke Masaa'il me se Wo Masla' lete hain
Jo Qur'an wa Hadees ke MUWAFAQ ho, Ye Mehaz
Darogh be Farogh hai,
Agar Koi Ghair-Muqallid, Is Ghalat Fahmi ka
Mareez hai to Aa'iye Ek MAJLIS muqarrar karein
Hum Mukhtalif Abwaab FIQH se 100 Masaa'il
Aap ke saamne Rakhenge aur MISRI TYPE ki
Hadees ki Kitabein aur Ghair Mutarjam Qur'an
Paak denge. Aap Pehle har Masla' me Charon
Imamon ka MASLAK bayan karenge Phir Har
Imam ke Dalaa'il bayaan Karengey aur Phir
SAHEEH SAREEH GHAIR MU'ARIZ Hadees se Ek
Imam ke Qoul ko SAHEEH aur 3 Imamon ke
Aqwaal ko Ghalat Saabit Karengey. Humne Kayi
Saalon se Ye CHALLENGE de rakha hai Lekin
Ghair-Muqallideen ki taraf se MAUT ki si
KHAMOSHI hai aur In sha' Allah! Soor Israfeel
tak Yehi Khamoshi Rahegi.
ZAROORI NOTE:
Quran wa Hadees aur Fiqh me MUKHAALIFAT
Saabit Karne ke liye 3 Baatein Zaruri hain.
1. Quran wa Hadees ka Poora Ilm ho.
2. Fiqh ke Masla' ko Poora aur Saheeh samjha
ho.
3. Fuqaha' ne iski Daleel bayan ki ho to Uska
Jawab de. Koi baat Quran ki Sareeh Aayat Ya
Saheeh Sareeh Hadees ke alaawah Na Karey.
RASOOLULLAH (sallallahu alaihi wa sallam) KA EK
AUR FAISLAH:
Rasoolullah (sallallahu alaihi wa sallam) ne
Sahaba-e-Kiraam (raz.) ki Ek Jama't ko BANU
QURAIZAH ki taraf bheja aur Badi TAAKEED se
farmaya: "Hargiz Koi Shaqs Asar ki Namaz na
parhe magar BANU QURAIZAH pohanch kar."
Lekin Jab Asar ka aakhri Waqt aa gaya to Ba'z
Sahaba (raz.) ne Raaste me Namaz parh li aur
ba'z ne Qaza' kar ke BANU QURAIZAH me Ja kar
parhi. Rasoolullah (sallallahu alaihi wa sallam) ne
Kisi par Aitraaz na Kiya. [Saheeh Bukhari 2/591]
Hafiz Ibnul Qayyim waghera Ulema' farmaate
hain ke, Bazaahir Yahan Quran wa Hadees me
Ta'ruz ho gaya tha.
Quran kehta hai ke, Bila-raib Namaz Farz hai
Mu'mineen par Jiska waqt muqarrar hai.
Ek Fareeq ne soch ke Namaz ka waqt isiliye
Muqarrar hain ke Namaz waqt ke andar parhi
Jaye. Isliye Unhoney Quran ke is Qaaidah par
amal karte hue Namaz waqt ke andar parhi aur
Hadees me Taaweel kar li ke Rasoolullah
(sallallahu alaihi wa sallam) ka Maqsad Namaz
Qaza' karwana Hargiz Na tha balke maqsad tha
ke Itni Jaldi karo ke Asar ke waqt me hi BANU
QURAIZAH pohanch Jaao.
Doosre Fareeq ne Quran ki Aayat me Taaweel ki
ke Ye Qurani Usool to bar-Haqq hai magar Aaj ki
Namaz ko Rasoolullah (sallallahu alaihi wa
sallam) ne is se Mustashnaa (alag) farma diya
hai.
Ibnul Qayyim (rah.) farmate hain Jinhoney
Raaste me Namaz parhi thi Unko 2 Ajar miley
aur Jinhoney Qaza' kar ke Parhi thi Unko 1 Ajar
mila. [Zaad Al-Mi'aad 2/71]
Ab Dekhiye! Rasool (sallallahu alaihi wa sallam)
ne Sahaba (raz.) ke is Ijtihad par Na to Ye kaha
ke Mere Sahaba (raz.) ki Ek Jama't ne Quran ki
Mukhalifat ki hai aur Na Ye kaha ke Mere Sahaba
(raz.) ki Doosri Jama't ne Saheeh Sareeh Hadees
ki Mukhaalifat ki hai. Aur Na Sahaba (raz.) ki
dono Jama'ton ne Ek doosre ko Mukhalif Qura'n
aur Mukhalif Hadees Kaha hai.
Is Hadees se ma'loom hua ke Jis masla' me
Dalaa'il Shariyah Muta'riz ho Wahan Mujtahideen
ko Ye Haqq hai ke Wo Koi Ek Pehloo ko Iqtiyaar
Karein Magar Ye Haqq Mujtahideen ko bhi Nahi
hai ke Apne Madd-e-Maqaabil ko Quran ya
Hadees ka Mukhaalif kahein.
Rasoolullah (sallallahu alaihi wa sallam) ki Is
Hadees ki bunyaad par hi Hum Muqallideen
(Hanafi, Shaafa'i, Hanbali wa Maaliki) Ek doosre
ko Quran wa Hadees ka Mukhaalif Nahi kehte.
Hum Imam Abu Haneefah (rah.) ke MUQALLID
hain aur Baaqi 3 A'immah ko Aala darjah ke
Mujtahid maantey hain. Unko Mat'oon Tehrana
In Ahadees-e-Saheehah wa Sareehah ki
Mukhaalifat Kehlaayegi. Aur Hum Ahnaaf
MUNKAR-E-HADEES hargiz Nahi hain.
La-Mazhab (Naam Nihaad) Ahle Hadees
Rasoolullah (sallallahu alaihi wa sallam) ki In
Ahaadees ko Nahi maante isiliye A'imma-e-Araba'
ke Haqq honey me Inko Abhi tak DOUBT hai.
Muttaba'-e-Nafs ka mazaa laga hai Isliye, in
A'immah ke Ijtihaadiyah Masaa'il ka Mazaaq
Udaatey hain.
Inke Ijtihaad ko Rasoolullah (sallallahu alaihi wa
sallam) se Iqtilaaf ke Zamrey me shumaar kartey
hain aur Khaas kar Ahnaaf ko ye log Nishaanah
banaatey hain. Inki Kayi Kitabein hain Jinme In
logon ne Imam Abu Haneefah (rahmatullahi
alaih) ke Ijtihaad ko Rasoolullah (sallallahu alaihi
wa sallam) se IQTILAAF karne me shumaar kiya
hai.
